Terms & Conditions

Last Updated: 12 May 2025
Effective Date: 12 May 2025

1. Definitions

In these Terms & Conditions, the following terms have the meanings set out below:

2. Acceptance of Terms

By using this website or booking a place in any Plainspoken Service, you agree to be bound by these Terms & Conditions. If you do not agree, you should not use the website or book any Service.

Participation in Plainspoken Services is limited to individuals aged 18 years and over. By booking, you confirm that you meet this requirement and have the legal capacity to enter into an agreement.

3. Service Description

Plainspoken offers in-person, practice-based workshops and facilitated sessions focused on listening and conversation skills. The Services are educational and reflective in nature. They are not counselling, therapy, medical treatment, legal advice, or any regulated professional service.

Services are currently available in person at our Johor Bahru studio only. We do not currently offer online or remote sessions.

We reserve the right to reschedule or cancel a session where minimum participant numbers are not met or where circumstances beyond our control make delivery impractical. In such cases, we will offer an alternative date or a full refund of any amount paid.

4. Booking and Enrolment

A booking is confirmed when we send written confirmation by email. Places are limited and confirmed on a first-come basis. Sending an enquiry does not itself constitute a confirmed booking.

You are responsible for ensuring that any other person attending alongside you (such as a partner or family member) is also aware of and agrees to these Terms & Conditions.

5. User Responsibilities

When attending a session, you agree to:

We reserve the right to ask any participant to leave a session if their conduct materially disrupts the group or breaches these terms, without refund.

6. Intellectual Property

All materials provided as part of our Services, including workbooks, prompt cards, and reading group selections, are the intellectual property of Plainspoken. They are provided for personal use by the participant only.

You may not reproduce, distribute, or use any Plainspoken materials for commercial purposes or share them publicly without our prior written consent.

7. Payment and Cancellation

All prices are listed in Malaysian Ringgit (RM). Payment details are provided at the time of booking confirmation. We accept bank transfer and standard Malaysian digital payment methods.

Cancellation by participant:

Cancellation by Plainspoken:

If we cancel a session for any reason, we will offer an alternative date or a full refund of any amount paid.

8. Disclaimers

The Services are provided for educational and reflective purposes only. Plainspoken makes no representation that participation in any session will produce specific personal outcomes or resolve any particular family situation.

Nothing in the Services constitutes professional advice — whether legal, medical, psychological, or financial. If you require professional support, you should seek it independently from an appropriately qualified practitioner.

9. Limitation of Liability

To the maximum extent permitted by law, Plainspoken's total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid for the specific session or format to which the claim relates.

We are not liable for indirect, consequential, or special damages of any kind, including loss of time, emotional distress, or relationship outcomes, whether arising in contract, tort, or otherwise.

10. Indemnification

You agree to indemnify Plainspoken against any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your conduct during a session, to the extent permitted by applicable law.

11. Termination

Either party may end an ongoing subscription with 30 days' written notice. Upon termination by Plainspoken without cause, any unused sessions will be refunded on a pro-rata basis. Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute shall first be addressed through direct discussion between the parties.

If direct resolution is not possible within 30 days, either party may refer the matter to the courts of Johor Bahru, Malaysia, which shall have exclusive jurisdiction.

13. General Provisions

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
